So what is the current situation with rent control in HTB? Is there, or is there going to be any change in the exemption status?

Hoboken's law is simple: after the filing of a master deed, any condominium conversion automatically becomes subject to rent control.

BDLJ's rent control exemption was enacted to stimulate residential development (and rental) in a delapidated former industrial area. This exemption no longer applies, as the building has new owners - Toll Bros. - who have converted it to condos.

The rent control is in effect not to protect the poor, in this instance, but to protect current tenants from unfair rental increases aimed solely at getting around the non-eviction plan Toll sponsored as a way to get the development approved.

That said, Toll is ignoring the law.

The City of Hoboken is ignoring the law.

The rent control office officially stated (and it has been documented in a letter posted here and elsewhere), that rent control is in effect. They are simply not enforcing the law until a tenant brings a case before them.

A friend of mine bought a small 6 unit building in Brooklyn several years ago to rent and also to sell as condos, thinking once it went condo, the rent control laws in the area would "soften." Not so. One of his tenants brought a case against him and won. That said, he was saddled with rising costs, a stiff ceiling on his rentals, and the inability to sell single units for eons. Overcoming or not overcoming existing laws/statutes depends on who is suing who, and just how good their lawyers are.

The situation could actually escalate very easily. just write a letter and request to have the legal rent calculated refering to carols orignal letter.

Then the city will have to respond either by calculating the legal rent or by saying that the building is not rent controlled.

If you google the hoboken and rent crontrol the required forms come up, is an easy process, you just need a copy of your lease,
